1. License & Permitted Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service to create and export images and related outputs ("Outputs").

You own your uploads and Outputs. You retain all rights to content you upload ("User Content") and to the resulting Outputs, subject to any third‑party rights within your uploads.

You grant us a worldwide, royalty‑free license to host, process, display, and store your User Content and Outputs solely to operate and improve the Service (e.g., rendering, autosave, troubleshooting, backups).

1.1 Allowed Uses

• Create unlimited Outputs for personal or commercial projects.
• Use features including borders, backgrounds, gradients, shadows, rounded corners, layouts, annotations, 3D elements, and canvas editing.
• Export images up to 10k resolution and save your projects.
• No attribution required.

1.2 Prohibited Uses

• Uploading unlawful content or infringing others’ intellectual property.
• Reverse engineering, scraping, or attempting to bypass technical limits or rate limits.
• Reselling, sublicensing, or offering the Service to third parties as a competing product.
• Redistributing any part of our interface, templates, or brand assets as your own.

3. Unauthorized Resale & Distribution

You may NOT:

• Resell, redistribute, or repackage our UI, templates, or brand assets.
• Offer Outputs as a competing template library without meaningful original value.
• Use the Service to create datasets for AI training without written consent.

Violations may lead to suspension or termination and legal enforcement where applicable.

4. AI & Machine Learning Restrictions

Content from the Service may NOT be used for:

• Training AI models or machine learning algorithms without express written permission.
• Generating derivative datasets from our UI, templates, or brand assets.
• Integrating our content into AI tools that compete with or replace the Service.

Why? Protecting user and platform IP ensures fair use and the integrity of the Service.

Violations may result in account suspension and legal action.

5. Accounts & Service

You are responsible for safeguarding your account credentials and for all activities under your account. Do not share your login. Notify us immediately of any unauthorized use.

5.1 Service Changes

We may add, remove, or modify features. We aim to provide reasonable notice for material changes where practical.

5.2 Availability & Data

• The Service is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted uptime or retained storage; keep your own backups of important work.

5.3 Feedback

If you submit feedback or suggestions, you grant us a perpetual, royalty‑free license to use them without obligation.

6. Payments & Subscriptions

Billing

• If you purchase a paid plan, you authorize recurring charges until cancellation.
• Prices and features may change; we’ll notify you of material changes to paid plans.

Payment Gateways

• We use Razorpay and PayPal to securely process payments.
• For customers in India (INR), payments are processed via Razorpay.
• For customers outside India, payments are processed via PayPal (through our Razorpay integration where applicable).

Refunds

• Digital services are generally non‑refundable. If a renewal occurred unintentionally and the Service has not been used after renewal, contact us within 14 days and we may issue a goodwill refund.

7. Intellectual Property

Accounts violating these rules may be suspended or terminated.

8. Plans & Usage Examples

• Plans are for individual use. Account sharing is prohibited.
• Unused exports do not roll over unless explicitly stated.

Cancel before renewal to avoid future charges. See Refunds above.

9. Refund Policy

General

• Digital services are typically non‑refundable.
• For unintended renewals with no post‑renewal usage, contact us within 14 days and we may issue a goodwill refund.

10. Account Management & Fair Usage

Security & Access

• You are responsible for keeping your account credentials secure.
• One account per individual. Team access requires appropriate licensing.

Fair Usage

File sharing is strictly prohibited.

• Only the purchaser (license holder) may use the account and Outputs.
• Do not share exported assets as a competing template library.
• For teams, purchase an appropriate plan or team license.

Violations may result in account suspension or termination.

11. Ownership

Ownership

• Clicks by Nextjsshop retains ownership of the Service, software, documentation, and brand assets.
• Users retain ownership of their uploads and Outputs created via the Service.

Branding

• Our trademarks, logos, and trade dress may not be used without written permission.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Disputes shall be resolved exclusively in the courts of India, located in Mumbai, Maharashtra.
